Welcome to the Holiday Giveaway Garden.

These Terms of Service (“Terms”) govern your use of the website operated by ConCardia, LLC (“Company,” “we,” “us,” or “our”). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Description of Service (Not a Sweepstakes)

The Holiday Giveaway Garden is a digital content discovery platform. It allows users (“Participants”) to discover, unlock, and claim free digital gifts, coupons, courses, and resources provided by third-party partners (“Contributors”).

For the avoidance of doubt:

• This website is not a lottery, sweepstakes, raffle, or game of chance.
• There is no element of “luck” involved in receiving a gift.
• Gifts are available to all eligible Participants who choose to “claim” them, subject to availability and the specific redemption terms of the Contributor.

2. Eligibility

You must be at least 18 years of age to use this Service. By creating an account, you warrant that you are at least 18 years of age and generally competent to enter into a binding contract.

3. Account Access and Security

• Authentication: We use “Magic Links” (secure email tokens) to authenticate users. You are responsible for maintaining the security of your email account. Any action taken through a link sent to your email is deemed to be taken by you.
• Accuracy: You agree to provide accurate, current, and complete information (specifically Name and Email) during the registration process.

4. The Data Exchange

You acknowledge that access to the Holiday Giveaway Garden is provided in exchange for your contact information and your consent to receive communications.

• Sponsors: By registering, you agree that your name and email address will be shared with our Event Sponsors for marketing purposes.
• Gift Contributors: When you affirmatively “Claim” a gift, your contact details are transferred to the specific Contributor providing that gift so they may fulfill the delivery and contact you regarding their services.

5. Third-Party Content and No Liability

Crucial Notice: ConCardia, LLC acts solely as a venue to connect Participants with Contributors.

• No Control: We do not control, endorse, or assume responsibility for any product, service, or content offered by third-party Contributors.
• Fulfillment: The specific Contributor is solely responsible for delivering the gift, providing support, and honoring any offers.
• Release: You agree that ConCardia, LLC shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. If a Contributor fails to deliver a gift or sends you unwanted emails, your dispute is with that Contributor, not us.

6. User Conduct

You agree not to use the Service to:

• Use scripts, bots, or automated systems to “Claim” gifts or generate referrals.
• Register with temporary, disposable, or fake email addresses.
• Attempt to bypass the “Magic Link” authentication or interfere with the proper working of the Service.

Violation of this section may result in the immediate termination of your account and the revocation of all claimed gifts.

7. Intellectual Property

The underlying software, “Holiday Giveaway Garden” design, badges, and gamification elements are the exclusive property of ConCardia, LLC. The specific gift images and descriptions are the property of their respective Contributors, used here with permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. CONCARDIA, LLC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE OPERATION OF THE SERVICE OR THE ACCURACY OF THE CONTENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CONCARDIA, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED $100.00 USD.

10. Indemnification

You agree to indemnify and hold harmless ConCardia, LLC from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Connecticut, United States, without regard to its conflict of law provisions.
